Magento – ePrivacy, Cookie Regulation and new legal situation after the ECJ judgment of 01.10.2019 *soon Magento extension for cookie Regulation *

Has long been the subject “Cookies” hotly debated. To what extent must be informed about cookies used users and especially WHEN and WHERE.

Is it enough a cookie notice when the page as e.g.. “This site uses cookies – more information can be found in our Privacy Information” display? Ansich the train at that moment was already departed and set cookies.
This changed with the times a little and some of the cookie evidence indicated which cookies used the side but again, it was usually too late.

This upstream cookie Note was seen legally disputed – you need it, you do not need it? From user side he was less controversial – He was probably more difficult unpopular (“if it's too late anyway – Why I then more again clearing the window?”).
What, however, clear and (legally) was clearly regulated – Visitors must be informed in the privacy information specifically about the cookies used.

This post is not to cover all the details of the decision in the process and kept colloquially as possible. Possible only relevant things should therefore be illuminated.

the ECJ (European Court) has now -at 01.10.2019- a decision met (interesting way,, that used to decide no SSL connection or. the complete search the site runs unencrypted), which is at least consistent, connected albeit with high technical requirements:

  1. The visitor must be informed of the use on the website cookies BEFORE they are placed and
  2. using ACTIVE must agree – that is “Opt-In” and not “Opt-Out”.

This has been associated with the ePrivacy Regulation (ESRP) addressed, allegedly 2020 to come. Here are of course other great ideas of thinkers & handlebar in it. or for the purchase of fiction and reality. Meaning and meaninglessness you can probably discuss indefinitely.

My personal opinion: Lots The new rules bring website owners in legal and technical difficulties and bring the alleged beneficiaries (visitors to the pages) absolutely nothing – sometimes they make it even more complicated. The Abmahnindustrie pleased, which in turn leads to the desire of preventing the Abmahnindustrie….
Let's face: Who was the last privacy, Cancellation, Participation-, Terms and conditions etc. Read before he has set the necessary hooks?
By actively necessary hooking of possible cookies when you visit the website M.E be. soon many reporting- and evaluation tools be meaningless. Why would a user to agree for example the use of Google Analytics when it needs to pay an extra tick and in return has absolutely nothing of it?

Now back to the cookie's history: How to implement this requirement, the ECJ decision in their Magento shop? With this question we have set ourselves apart and have been working on a solution. We will refer this Notice- and cookie requirements with a Magento extension for both Magento 1 and Magento 2 timely in our Shop to offer. We also have two other extensions about privacy nearing completion, dealing with the anonymity of backend customer data (out now HERE) put and admin roles, and the display of phone numbers in the front end apart. So it pays to our blog and the shop (as well as Facebook) to keep in mind.
